NOTICE TO RHYS CHRISTIAN HERNANDEZ, NAMED FATHER
Rhys Christian Hernandez is notified that a petition for adoption of a child, named Ava Nicole Gabriel, born to Lea Gabriel Foerg (F/K/A Lea Sonday Gabriel) on November 7, 2012, was filed in the Office of the Clerk of the Pulaski County Circuit Court, 112 East Main Street, Winamac, Indiana, 46996, on January 15, 2026 at 1:15 PM. The petition for adoption alleges that the consent of Rhys Christian Hernandez, the biological father, is not required, pursuant to Section 31-19-9-8 of the Indiana Code, on the grounds that Rhys Christian Hernandez is a parent of a child in the custody of another person and for a period of at least one (1) year that he has either failed without justifiable cause to communicate significantly with the child when able to do so; or he has knowingly failed to provide for the care and support of the child when able to do so as required by law or judicial decree.
If Rhys Christian Hernandez seeks to contest the adoption of the child, Rhys Christian Hernandez must file a motion to contest the adoption in accordance with IC 31-19-10-1 in the above named court not later than fifteen (15) days after the date of service of this notice.
If Rhys Christian Hernandez does not file a motion to contest the adoption within fifteen (15) days after service of this notice the above named court will hear and determine the petition for adoption. The consent to adoption of Rhys Christian Hernandez will be irrevocably implied and Rhys Christian Hernandez will lose the right to contest either the adoption or the validity of Rhys Christian Hernandez’s implied consent to the adoption.
No statement made to Rhys Christian Hernandez relieves Rhys Christian Hernandez of Rhys Christian Hernandez’s obligations under this notice.
This notice complies with IC 31-19-4.5-3 but does not exhaustively set forth a person’s legal obligations under the Indiana adoption statutes. A person being served with this notice should consult the Indiana adoption statutes. As stated above, any motion to contest the adoption in accordance with IC 31-19-10-1 in the above named court must be filed not later than fifteen (15) days after the date of service of this notice.
