NOTICE TO TAXPAYERS REGARDING DETERMINATION OF
PULASKI COUNTY, INDIANA, TO ENTER INTO A LEASE AND A
FIRST AMENDMENT TO SAID LEASE WITH THE PULASKI COUNTY
COURTHOUSE BUILDING CORPORATION

The taxpayers of Pulaski County, Indiana (‘County’), are hereby notified that on 2 October 2023 the Board of Commissioners of the County (‘Board’) did adopt a resolution determining that the County will take all actions necessary to enter into a lease (‘Original Lease’) with the Pulaski County Courthouse Building Corporation (‘Corporation’), and that on 16 October 2023 the Board did further adopt a resolution determining that the County will take all actions necessary to enter into a first amendment to the Original Lease (the Original Lease as amended by this first amendment: ‘Lease’), which in turn will allow the Corporation to issue bonds (‘Bonds’), payable from the lease rentals received from the County pursuant to the terms of the Lease. The Bonds may be issued in one or more series or issues, in an original aggregate principal amount not to exceed Twelve Million Seven Hundred Fifty Thousand Dollars ($12,750,000), for the purpose of procuring funds to pay for the costs of the financing of all or any portion of the financing of the renovation, improvement, and equipping of the Pulaski County Courthouse located at 112 East Main Street, Winamac, Indiana, and the construction, renovation, repair and equipping of other improvements and projects related thereto.

The Lease will have a term ending on a date not later than twenty (20) years from the date of issuance of the Bonds. The annual lease rental payable under the Lease shall not exceed One Million One Hundred Thirty-Five Thousand Dollars ($1,135,000) per year payable in semiannual installments on 30 June and 31 December of each year during the term of the Lease. The County shall pay lease rentals under the Lease solely from solely from the revenues of an ad valorem tax levied by the County on all taxable property in the County pursuant to Indiana Code 36-1-10-17, as amended.
