AN ORDINANCE ANNEXING REAL PROPERTY FOR THE
INCORPORATED TOWN OF FRANCESVILLE, INDIANA

Ordinance No. 2025-4

Recitals   

WHEREAS, the Town Council for the Town of Francesville, State of Indiana (the “Town Council”), is responsible for the performance of various functions for the Town of Francesville, Indiana (the “Town”); and

WHEREAS, certain owners of real property located within the County of Pulaski, State of Indiana (the “County”) have submitted a petition for annexation (the “Petition”) attached hereto as Exhibit A and incorporated herein by reference; and 

WHEREAS, I.C. 36-4-3-5.1 allows for the annexation of real property, provided that One Hundred Percent (100%) of landowners that reside within the territory that is proposed to be annexed agree to the annexation and duly submit a petition to that effect; and

WHEREAS, the Town held a public hearing, in accordance with I.C. 36-4-3-5.1, on December 4, 2024, at the Town Hall, located at 100 N. Brooks St., Francesville, IN, at 6:30 p.m. (EST) and considered public comment and remonstrances before any action was taken; and  

NOW, THEREFORE, BE IT RESOLVED, by the Town Council of the Town of Francesville, Indiana, that the following Ordinance Annexing Real Property for the Incorporated Town of Francesville, Indiana, is hereby adopted as follows:

Section I.

Adoption

1. The Recitals are hereby incorporated by reference. 

2. The following parcels of property are the subject of the Petition and will be considered as part of the proposed annexation at the public hearing:

(a) 66-15-04-400-017.000-013, containing approximately 5.00 acres; 

(b) 66-15-04-400-013.000-013, containing approximately 5.00 acres; 

3. There shall be no special terms and conditions as part of the proposed annexation, and no tax abatements have been requested by the petitioning property owner(s). 

SECTION II.

Effective Date and Notices

1. This Ordinance shall become effective only after a public hearing has been conducted, pursuant to IC 36-4-3-5.1, and no less than fourteen (14) days have elapsed following that public hearing. 

2. All proper notices shall be provided in accordance with Indiana law.
