AN ORDINANCE ANNEXING REAL PROPERTY FOR THE
INCORPORATED TOWN OF WINAMAC, INDIANA
Ordinance No. 3 of 2024
Recitals
WHEREAS, the Town Council for the Town of Winamac, State of Indiana (the “Town Council”), is responsible for the performance of various functions for the Town of Winamac (the “Town”); and
WHEREAS, certain owners of real property located within the County of Pulaski, State of Indiana (the “County”) have submitted petitions for annexation (the “Petitions”) attached hereto as Exhibit A and incorporated herein by reference; and
WHEREAS, I.C. 36-4-3-5.1 allows for the annexation of real property, provided that One Hundred Percent (100%) of landowners that reside within the territory that is proposed to be annexed agree to the annexation and duly submit a petition to that effect; and
WHEREAS, the Town shall hold a public hearing, in accordance with I.C. 36-4-3-5.1, on March 11, 2024, at the Winamac Municipal Complex, located at 623 W. 11th St., Winamac, IN 46996, at 6:00 p.m. (EST) to consider any public comment and remonstrances before any action is taken; and
NOW, THEREFORE, BE IT RESOLVED, by the Town Council of the Town of Winamac, Indiana, that the following Ordinance Annexing Real Property for the Incorporated Town of Winamac, Indiana, is hereby adopted as follows:
Section I.
Adoption
1. The Recitals are hereby incorporated by reference.
2. The following parcels of property are the subject of the Petitions and will be considered as part of the proposed annexation at the public hearing:
NORTH PLAZA OF WINAMAC, LLC, properties:
(a) 66-07-12-200-051.001-010, containing 1.57 acres, more or less;
(b) 66-07-12-231-003.000-010, containing 1.01 acres, more or less;
(c) 66-07-12-231-002.000-010, containing 0.00 acres, more or less;
(d) 66-07-12-231-001.000-010, containing an indeterminable amount of acreage;
GALCO, INC, properties:
(a) 66-07-12-200-051.000-010, containing 108.28 acres, more or less;
(b) 66-07-12-200-001.000-010, containing 5.75 acres, more or less;
(c) 66-14-12-200-001.000-011, containing 4.25 acres, more or less
SVG, INC., properties:
(a) 66-14-11-100-012.000-011, containing 4.48 acres, more or less;
(b) 66-14-12-200-008.000-011, containing 1.23 acres, more or less.
3. There shall be no special terms and conditions as part of the proposed annexation, and no tax abatements have been requested by the petitioning property owner(s).
4. The Town has received the Petitions from the landowners listed in Section 2 of this Ordinance. This Ordinance is for purposes of publication, and following a public hearing, may be modified or amended to reflect remonstrances, public input, and further investigation. The Town does not make any warranties of fitness for annexation by virtue of this Ordinance, and shall make that determination following the public hearing that will take place on March 11, 2024, at the Winamac Municipal Complex, located at 623 W. 11th St., Winamac, IN 46996, at 6:00 p.m. (EST).
SECTION II.
Effective Date and Notices
1. This Ordinance shall become effective only after a public hearing has been conducted, pursuant to IC 36-4-3-5.1, and no less than fourteen (14) days have elapsed following that public hearing.
2. Notice shall be published in The Pulaski County Journal one (1) time prior to the public hearing, in accordance with I.C. 5-3-1.
