AN ORDINANCE AMENDING THE MONTHLY RATES AND CHARGES FOR THE USE AND SERVICES RENDERED BY THE WATER WORKS FOR THE TOWN OF FRANCESVILLE, INDIANA

Ordinance No. 3 of 2025

WHEREAS, the Town of Francesville, Indiana (“Town”) now owns and operates a municipal Water utility in accordance with the provisions of Title 8, Article 1.5 of the Indiana Code, and acts amendatory thereof and supplemental thereto, furnishing the public water services to said Town and its inhabitants; and    

WHEREAS, the Town Council of the Town (“Town Council”) currently has in place a Water Works rate ordinance, for the purposes of setting forth water utility rates for the Town’s residents and other users (the “Current Ordinance”); and 

WHEREAS, the Town Council finds that the rates and charges of the Water Works should be increased and that it is necessary to amend the Current Ordinance; provided, however, that the rates and charges set forth in the Current Ordinance shall remain in full force and effect until passage of this Ordinance, at which time the rates and charges set forth herein shall become effective; and 

 WHEREAS, the Town Council finds that the rates and charges set forth herein are reasonable and just, based upon the aforementioned rate study and the cost of providing service to the customers of the Water Works; and 

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF FRANCESVILLE, INDIANA, THAT:

Section I. 

Rates and Charges

1. The Recitals are incorporated herein by reference. 

2. The Current Ordinance shall be repealed upon proper publication of this Ordinance, as set forth in Section II, and Ind. Code § 5-3-1-4. 

3. The new rates and charges pursuant to this Ordinance are set forth in Exhibit A, attached hereto and incorporated herein by reference. These new rates shall become effective upon proper passage of this Ordinance, as further set forth in Section II. 

Section II.

Effective Date

This Ordinance shall become effective thirty (30) days after notice of the adoption has been published in a paper as described in Indiana Code § 5-3-1-4.

E. Miscellaneous Charges

Tap Fees: The charge for one inch or smaller connection shall be Two Thousand Five Hundred Dollars ($2,500.00). For any connections larger than one inch. the charge shall be an amount sufficient to reimburse the water department for labor, material, and overhead necessary for tapping the main, installation of service from the main to the property line (including curb stop). and the cost of furnishing and installing a suitable water meter. In no event shall the charge for such connection be less than Two Thousand Five Hundred Dollars ($2,500.00).

Customer Deposits: The Town Clerk-Treasurer shall be empowered to require the payment of a customer deposit of Two Hundred Dollars ($200.00) from the prospective customers of the Town Water Utility for water service prior to the furnishing of such services. Such customer deposit shall be refunded to the customer upon the payment of the final charges for water service after the discontinuance of such services to the customer. Such customer shall deposit and shall not be required of persons who hold title of real estate in fee simple sufficient to guarantee the payment of the costs for such water service.

Disconnect/Reconnect Fees:

New Water Meter: $50.00 plus actual cost of meter to be charged if new meter is installed at customer’s request and old meter is not faulty.

Pulling of Water Meter (customer request) $35.00

Re-installing Pulled Meter $35.00

Turn off Water Meter for Repair: First time courtesy, thereafter $35 per visit.

Thaw Frozen Water Meter: First time a courtesy; Second time $100.00; Each subsequent visit shall be $200, plus $50.00 for replacement.

Unauthorized Water Usage: $150.00 for first offense plus estimated water usage; $250.00 for each subsequent offense and theft report will be filed.

Water Leak Check: One courtesy check per 24-month period; thereafter $35.00/visit
