A RESOLUTION NOT TO TRANSFER EDIT FUNDS
TO THE TOWN OF WINAMAC GENERAL FUND

Resolution No. 6 of 2016

WHEREAS, the Winamac Pool Committee (the “Committee”), is in the process of soliciting donations and monetary commitments and matches from interested individuals and businesses for the purposes of design, construction, and maintenance of a town pool; and 

WHEREAS, the Town Council of the Town of Winamac (the “Council”) has agreed to make an irrevocable donation of funds in the amount of One Hundred and Fifty Thousand ($150,000.00) Dollars to the Committee, for use in the design, construction, and maintenance of a town pool; and

WHEREAS, pursuant to Ind. Code § 6-3.5-7-12.7, the Council may, at any time, transfer to its general fund, money that has been deposited in the economic development income tax fund (the “EDIT fund”) established by the Town of Winamac (the “Town); and

WHEREAS, Resolution No. 2 of 2016, passed on the 28th of April, 2016, by majority vote by the Council, authorized the transfer of One Hundred and Fifty Thousand Dollars ($150,000.00) from the EDIT fund to the general fund; and 

WHEREAS, after further consideration, the Council believes it to be in the best interests of the Town to not authorize said transfer until such a time as the One Hundred and Fifty Thousand Dollars ($150,000.00) can be appropriated for said transfer, without the need for application for an additional appropriation from the Department of Local Government Finance. 

NOW THEREFORE, BE IT ORDAINED by the Town Council of the Town of Winamac, Indiana, that this Resolution Not to Transfer Edit Funds to the Town of Winamac General Fund is adopted as follows:

SECTION I.

Rescission of Resolution

1. Rescission. Resolution No. 2 of 2016, passed and adopted on the 28th day of April, 2016, in a meeting open to the general public, is hereby rescinded, and the One Hundred and Fifty Thousand Dollar ($150,000.00) transfer from the EDIT Fund to the Town’s General Fund, is hereby cancelled. 

2. Signatory Authority. The Council’s grant of authority to Mr. Kenneth McFarland to sign the Non-Permanent Fund Agreement with the Community Foundation of Pulaski County is hereby rescinded. It is the Town’s desire that the signatory be the newly formed Town of Winamac Board of Parks and Recreation. 

SECTION III.

Effective Date

1. Effective Date. This Resolution shall become effective thirty (30) days after notice of the adoption shall have been published in a paper as described in Indiana Code § 5-3-1-4.
