AN ORDINANCE AMENDING THE MONTHLY 

WATER RATES AND CHARGES FOR THE USE AND SERVICES

RENDERED BY THE WATERWORKS OF THE 

TOWN OF WINAMAC, INDIANA

Ordinance No. 13 of  2017

WHEREAS, the Town of Winamac, Indiana (“Town”) now owns and operates a municipal Waterworks in accordance with the provisions of Title 8, Article 1.5 of the Indiana Code, and acts amendatory thereof and supplemental thereto, furnishing the public water supply to said Town and its inhabitants; and    

WHEREAS, the Town Council of the Town (“Town Council”) adopted Ordinance No. 15 of 2014 on October 13, 2014 (the “Current Ordinance”) amending the rates and charges for the use of and services rendered by the Waterworks of the Town as set forth in §53.01(A)-(D) of the Municipal Code of the Town (“Code”); and 

WHEREAS, the Town has heretofore established a public fire protection surcharge, after a financial study of the Waterworks was completed by the firm of H. J. Umbaugh & Associates, Certified Public Accountants, Mishawaka, Indiana, such decision being based upon such financial study and the Town Council having found that a public fire protection surcharge was necessary to recover the costs of providing public fire protection; and 

WHEREAS, the Town Council finds that the rates and charges of the Waterworks should be increased and that it is necessary to amend §53.01(A)-(G) of the Code and repeal the Current Ordinance; provided, however, that the rates and charges set forth in the Current Ordinance shall remain in full force and effect until passage of this Ordinance, at which time the rates and charges set forth herein shall become effective; and 

WHEREAS, the Town Council finds that the rates and charges set forth herein are reasonable and just, based upon the aforementioned rate study and the cost of providing service to the customers of the Waterworks; and 

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WINAMAC, INDIANA, THAT:

Section 1. §53.01(A) of the Code is hereby amended and restated as follows: 

“The rate for monthly consumption per 1,000 gallons of water usage is in accordance with the following chart:” 

(Outside corporate Town boundaries rates and charges are approximately 14.9% higher than the rates and charges for customers inside the corporate Town boundaries.)

Section 3. §53.01(C) of the Code is hereby amended and restated as follows:

Section 4. §53.01(D) of the Code is hereby amended and restated as follows:

Section 5.  §53.01(E) of the Code is as follows:

“The connection fee for a 3/4-inch water tap will be $700.  For 1-inch and larger water tap, the connection fee will be based on the actual time and materials required to make the tap.” 

Section 6.  §53.01(F) of the Code is hereby added as follows:

“The bulk rate for consumption per 1,000 gallons of water usage will be $20.00.”

Section 7.  The rates and charges set forth in the Current Ordinance shall remain in full force and effect until passage of this Ordinance at which time the rates and charges set forth herein shall become effective.

Section 8. Except as provided in Section 8 hereof, the Current Ordinance and all other ordinances and provisions of ordinances in conflict with the provisions of this Ordinance are hereby repealed. 

Section 9.  This Ordinance shall be in full force and effect from and after its passage.
