The State of Indiana to the defendants above named, and any other person who may be concerned.

You are hereby notified the Defendants, Timothy W. Williams, Stacy L. Clemons, All Heirs and Claimants Known and Unknown of Timothy W. Williams, Midland Credit Management, Inc., Harvest Credit Management VII, LLC and LVNV Funding, LLC, are being sued in the Pulaski Circuit Court, Pulaski County, State of Indiana.

The nature of the suit is a civil action wherein the plaintiff has filed a Complaint on a Promissory Note and for Mortgage Foreclosure demanding judgment on a promissory note and the foreclosure of a mortgage on the defendant at the property located at 4337 N. 1400 W, Medaryville, Indiana 47957, in Pulaski County, Indiana which property is more particularly described as follows to-wit:

Part of the Northeast Quarter (1/4) of the Southeast Quarter (1/4) of Section Twenty-one (21), Township Thirty-one (31) North, Range Four (4) West, Pulaski County, Indiana more particularly bounded and described as follows: Commencing at a point 910 feet South and 232.2 feet West of the Northeast Corner of the Northeast Quarter (1/4) of the Southeast Quarter (1/4) of said Section 21; thence West 217.8 feet; thence North 200.4 feet; thence East 217.8 feet; thence South 200.4 feet to the place of beginning, containing 1 acre more or less.

Together with a right-of-way easement, for ingress and egress, on, over and across a 20 foot strip, described as follows: Commencing at a point 910 feet South of the Northeast Corner of the Northeast Quarter (1/4) of the Southeast Quarter (1/4) of said Section 21; thence West 232.2 feet; thence North 20 feet; thence East 232.2 feet; thence South 20 feet to the place of beginning. (Reference to Deed Record No. 142, page 589.)

MORE COMMONLY KNOWN AS: 4337 N. 1400 W., Medaryville, Indiana 47957. 

This Summons by Publication and Notice is specifically direct to the Defendants, Timothy W. Williams and All Heirs and Claimants Known and Unknown of Timothy W. Williams, whose whereabouts are unknown. You must answer or otherwise respond to the Complaint in writing, by you or your attorney, on or before the 10th day of November, 2018, and in case you fail to do so, Judgment by Default may be entered against you for the relief demanded by the plaintiff in the Complaint.

If you have a claim for relief against the plaintiff arising out of the transaction of occurrence that is the subject matter of the plaintiff’s claim, you must assert it in your written answer.
