An Ordinance Vacating a Public Roadway 

and Extinguishing Pulaski County, Indiana’s Claim to an 

Unimproved Publicly Unused Roadway

WHEREAS, the Commissioners of Pulaski County, Indiana (the “Commissioners”) had previously met in order to consider a Petition to vacate a public roadway and to extinguish claims to an unimproved publicly unused roadway; and 

WHEREAS, the unused public roadway is forty feet (40’) in uniform width, located west of County Road 100 N and bordering parcel number 66-17-06-300-032.000-010 to the north, parcel number 66-17-07-200-003.000-010 to the south, and the Tippecanoe River to the west; and 

WHEREAS, said roadway should be vacated and divided equally between the adjoining landowners, with the legal owner of parcel number 66-17-06-300-032.000-10 receiving the north twenty feet (20’) of said roadway, and the legal owner of parcel number 66-17-07-200-003.000-010 to the south becoming the legal owner of the south twenty feet (20’) of said roadway; and 

WHEREAS, this roadway is neither needed or necessary to the public at large nor to Pulaski County, Indiana; and 

NOW, THEREFORE BE IT ORDAINED as follows:

SECTION 1. The platted and unimproved publicly unused roadway forty feet (40’) in uniform width is hereby vacated, and Pulaski County, Indiana’s claim to the platted and unimproved publicly unused roadway is extinguished, and the forty feet (40’) strip of land shall be divided equally, as more fully set forth in the Recitals, between the adjoining landowners on the north and south.  

SECTION 2. The Commissioners of Pulaski County, Indiana, shall publish notice of this Ordinance in a newspaper of general circulation once each week for two (2) consecutive weeks, and on October 4, 2021, at 5:30 p.m. (EST), a public meeting shall be held at the Pulaski County Highway Garage, located at 1131 North U.S. 35, Winamac, IN 46996, to consider any remonstrances for persons interested in or affected by the proceeding.  After such remonstrances have been taken into consideration, final action shall be needed to confirm, modify, or rescind this Ordinance.     

SECTION 3. This Ordinance shall be effective upon passage, after the procedure in Section 2 of this Ordinance has been followed, and a copy shall be recorded in the Pulaski County Recorder’s Office and a copy delivered to the Pulaski County Auditor’s Office.
