ORDINANCE AMENDING 

PULASKI COUNTY DEVELOPMENT FEE SCHEDULE 

Pulaski County Ordinance No. 2020-04

WHEREAS, the Pulaski County Board of Commissioners (hereinafter referred to as “the County”) have the power and authority to amend the development fee schedule pursuant to Ind. Code 36-2-4-8; and

WHEREAS, the Advisory Plan Commission (hereinafter referred to as “PCAPC”) did on June 22, 2020 hold a special meeting to discuss recommending an amendment to the County of the development fee schedule as it pertains to the commercial solar farm development portion of the fee schedule which is currently $1,250.00 per mW + applicable special exception hearing fees, which was last modified and made effective on January 1, 2020. The relevant fee language is found in the Pulaski County Development Fee Schedule under Section C. Commercial/Industrial at subparagraph 5. Solar panel. The following amendment to this portion of the fee schedule has been presented to the County for their consideration:

C. Commercial/Industrial

5. Solar Energy Systems $15,000.00 fixed fee per project plus the cost of hiring any outside consultants to assist the Pulaski County Building Inspector in monitoring and approving development and construction plus a 5% surcharge (payable to the Pulaski County Building Department) on the total cost of all payments made to outside consultants that are hired by the Pulaski County Building Inspector on the project.

WHEREAS, the County being duly advised now approves said recommendation by the PCAPC; and 

THEREFORE, BE IT ORDAINED THAT:

The Pulaski County Development Fee Schedule is hereby amended to the following language as follows:

C. Commercial/Industrial

5. Solar Energy Systems $15,000.00 fixed fee per project plus the cost of hiring any outside consultants to assist the Pulaski County Building Inspector in monitoring and approving development and construction plus a 5% surcharge (payable to the Pulaski County Building Department) on the total cost of all payments made to outside consultants that are hired by the Pulaski County Building Inspector on the project.

Pursuant to Ind. Code 36-2-4-8 (e) this ordinance will be published one time within thirty (30) days from July 20, 2020 in accordance with Ind. Code 5-3-1. Implementation of the fee increase shall begin ninety (90) days after the date of publication.

Passed and adopted by the Board of County Commissioners of Pulaski County, Indiana, this 20th day of July, 2020 and effective ninety (90) days after the first publication, but no later than November 18, 2020.
