MEDARYVILLE TOWN COUNCIL

ORDINANCE NO. 2018-07-02

PROHIBITING THE PLACEMENT OR DISPOSAL OF
GRASS CLIPPINGS IN OR UPON ANY STREET, ALLEYWAY,
SIDEWALK, OR PUBLIC RIGHT OF WAY

WHEREAS, grass clippings are considered to be sources of water pollution; and

WHEREAS, the placement and/or disposal of grass clippings in or upon streets, alleyways, sidewalks, or public rights of way within the Town of Medaryville, Indiana creates an impediment to the drainage and disposal of storm water within the Town to the detriment to the public health, safety, and welfare of the citizens of the Town; and

WHEREAS, the placement or disposal of grass clippings in or upon the streets, alleyways, sidewalks, or public rights of way within the Town of Medaryville, Indiana is unsightly and has necessitated the expenditure of the Town funds in order to unclog storm water drains and otherwise protect the integrity of the Town’s storm water system; and

WHEREAS, the need exists to prohibit the placement or disposal of grass clippings in or upon any street, alleyway, sidewalk, or public right of way for the purposes of securing and promoting the public health, comfort, convenience, safety, welfare, and the peace of the residents of the Town.

NOW, THEREFORE, BE IT ORDAINED by the Medaryville Town Council for the Town of Medaryville, Indiana as follows:

1. Unlawful Disposal of Grass Clippings. It shall be unlawful for any person or entity to place or dispose of any grass clippings in or upon the streets, alleyways, sidewalks or public rights of way within the Town of Medaryville, Indiana. Every owner or operator of any premises shall keep the alleys, street, sidewalks, and public rights of way abutting on such premises free and clear of all grass clippings.

2. Enforcement Authority. The Town Marshal and/or his authorized designee shall be responsible for enforcing the terms of this Ordinance. The Town Marshal and/or his authorized designee shall have the authority to make inspections, determine violations, and take all actions necessary to enforce the provisions of this Ordinance.

3. Warning/Fines.

(a) Any person violating this Ordinance may, at the discretion of the Town Marshal, be issued a warning. If a warning is issued it shall be considered as affording the violator one (1) opportunity to comply with this Ordinance.

(b) Any person who violates the provisions of this Ordinance shall be subject to the following fine:

(1) 1st Violation: $50.00

(2) 2nd Violation: $75.00

(3) 3rd Violation: $100.00

(4) 4th Violation and every violation thereafter: $250.00

Each day such violation is committed or permitted to continue shall constitute a separate offense.

Passed by the Town Council of Medaryville, Indiana, this 18th day of July, 2018 by a vote of 3 to 0.
