MEDARYVILLE TOWN COUNCIL
ORDINANCE NO. 2020-12-01

AMENDING ORDINANCE NO. 2016-10-01 AND ORDINANCE NO.
2017-09-02 TO ESTABLISH THE SERVICE CHARGE FOR THE
COLLECTION AND REMOVAL OF GARBAGE 

WHEREAS, on October 28, 2016, the Medaryville Town Council enacted Ordinance No. 2016-10-01 entitled an Ordinance Establishing the Service Charge for the Collection & Removal of Garbage & Declaring Unlawful Deposits of Garbage on Real Estate a Public Nuisance; and 

WHEREAS, on September 20, 2017, the Medaryville Town Council enacted Ordinance No. 2017-09-02 entitled Amending Ordinance No. 2016-10-01 to Establish the Service Charge for the Collection and Removal of Garbage to set the service charge for the collection and removal of garbage for 2018, 2019, and 2020; and 

WHEREAS, the Town desires to now set the rate for the service charge for the collection and removal of garbage for 2021, 2022, 2023, and thereafter.

NOW, THEREFORE, BE IT ORDAINED by the Medaryville Town Council for Medaryville, Indiana as follows: 

1. Paragraph 3 in Ordinance No. 2016-10-01 and Paragraph 1 in Ordinance No. 2017-09-02 is hereby replaced with the following language: 

There is hereby imposed on each owner of real property in the Town of Medaryville, Indiana, for every occupant or tenant to whom municipal garbage collection is made available by the Town directly, or through any person, firm, or corporation, with which the Town may contract for the furnishing of such service, a service charge for the collection and removal of garbage according to the following schedule: 

• $14.50 for the year 2021

• $14.79 for the year 2022

• $15.09 for the year 2023

• For the year 2024 and thereafter, the service charge shall be the amount as listed in any contract entered into by the Town for garbage removal for that corresponding year. 

2. All other provisions of Ordinance No. 2016-10-01 and Ordinance No. 2017-09-02 not in conflict herewith shall remain in full force and effect. 

Passed by the Town Council of Medaryville, Indiana, this 17th day of December, 2020 by a vote of 3 yes to 0 no.
